These Terms and Conditions (“Terms”) govern the provision of mobile auto air conditioning regas and repair services (“Services”) by Mobile Auto Air Tech (“we,” “us,” or “our”) to you, the customer (“you” or “Customer”). By booking or accepting our Services, you agree to be bound by these Terms.
1. Scope of Services
1.1 We provide mobile auto air conditioning diagnostics, regassing, and repairs as agreed upon at the time of booking.
1.2 Services are limited to the agreed scope. We are not responsible for unrelated vehicle issues (e.g., mechanical or electrical faults) or pre-existing air conditioning system defects.
1.3 Regassing may not resolve underlying system faults (e.g., leaks). We will advise if further repairs are needed, subject to additional costs.
1.4 All Services comply with the Australian Refrigeration Council (ARC) standards and Queensland’s Environmental Protection Act 1994.
2. Bookings and Access
2.1 Bookings are confirmed upon receipt of a deposit (if required) or written agreement.
2.2 You must provide safe and clear access to the vehicle at the agreed time and location. This includes ensuring no hazards (e.g., aggressive pets, cluttered spaces) are present.
2.3 We may refuse or reschedule Services if access is deemed unsafe or inadequate, with no liability for delays.
3. Payment Terms
3.1 Fees are as quoted at booking, inclusive of GST unless stated otherwise. Additional work identified during Service will be quoted separately and requires your approval.
3.2 Payment is due in full upon completion of Services via cash, card, bank transfer.
3.3 We may, at our discretion, require a deposit for any bookings, the amount and terms of which will be communicated at the time of booking. Deposits are non-refundable for cancellations with less than 24 hours’ notice.
3.4 Overdue payments incur a late fee of $50 plus 5% interest per week until paid.
3.5 Non-payment may result in refusal of future Services and legal action to recover owed amounts.
4. Cancellations
4.1 You must provide at least 24 hours’ notice to cancel or reschedule a booking.
4.2 Late cancellations or no-shows incur a fee of 50% of the quoted Service price to cover travel and preparation costs.
4.3 We may cancel or reschedule Services due to unforeseen circumstances (e.g., weather, parts supply, equipment issues). You will be notified promptly, and no fees will apply.
5. Customer Conduct
5.1 You must treat our staff with respect. Abusive, threatening, or harassing behavior (verbal or physical) will result in immediate termination of Services and potential reporting to authorities.
5.2 We reserve the right to refuse or discontinue Services to Customers engaging in vexatious behavior, including repeated unfounded complaints, excessive demands, interference with our work or violating our Terms and Conditions.
5.3 Public Conduct and Defamation
5.3.1 You agree to refrain from making false, misleading, or defamatory statements about Mobile Auto Air Tech, its staff, or Services in any public forum, including online reviews, social media, or other platforms.
5.3.2 Defamatory statements include, but are not limited to, false claims about the quality of Services, staff conduct, or business practices that are intended to harm our reputation or business interests.
5.3.3 If you have a concern or complaint, you must follow the dispute resolution process outlined in clause 8, submitting issues in writing to contact@mobileautoairtech.com.au within 30 days of Service.
5.3.4 We reserve the right to take legal action to address defamatory statements, including seeking damages, injunctions, or removal of false content, in accordance with Queensland’s Defamation Act 2005. You may be liable for legal costs incurred.
5.3.5 This clause does not restrict your rights to provide honest feedback or exercise your consumer rights under the Australian Consumer Law.
6. Warranties and Liability
6.1 We provide Services with due care and skill, as required by the Australian Consumer Law (ACL). If Services are not fit for purpose or defective due to our fault, we will remedy the issue at no cost, subject to clause 6.3.
6.2 No warranty is provided for pre-existing vehicle issues, customer-supplied parts, or faults identified but not repaired (e.g., if you decline recommended repairs).
6.3 You must notify us of any issues in writing within 30 days of Service completion. We are not liable for claims made after this period or for issues unrelated to our Services. New components supplied and fitted by us will have the relevant manufacturers warranties and conditions attached.
6.4 Our liability is limited to the cost of the Services provided. We are not responsible for consequential losses (e.g., vehicle downtime, lost income).
6.5 You are responsible for ensuring your vehicle is roadworthy and suitable for air conditioning work. We are not liable for damage caused by undisclosed defects.
7. Refunds
7.1 Refunds are only provided if we fail to deliver Services as agreed or breach ACL guarantees.
7.2 No refunds are offered for change of mind, pre-existing vehicle faults, or issues outside our control.
7.3 Refund requests must be submitted in writing within 30 days of Service, detailing the issue. We will respond within 14 days.
8. Dispute Resolution
8.1 If you have a complaint, submit it in writing to contact@mobileautoairtech.com.au within 30 days of Service. Include details and supporting evidence (e.g., photos).
8.2 We will investigate and respond within 14 days. If unresolved, you may contact Queensland’s Office of Fair Trading for mediation.
8.3 Vexatious or repetitive complaints without merit may result in refusal of further Services, as per clause 5.2.
9. Privacy
9.1 We collect personal information (e.g., name, address, vehicle details) to provide Services, as outlined in our Privacy Policy.
9.2 Your data is stored securely and not shared without consent, except as required by law.
9.3 Contact us to access or correct your information. Privacy complaints can be directed to the Office of the Australian Information Commissioner.
10. Safety and Compliance
10.1 We comply with Queensland’s Work Health and Safety Act 2011 and ARC refrigerant handling regulations.
10.2 You must provide a safe work environment. We may refuse Service if conditions are hazardous, with no liability for delays.
10.3 You must not supply or request unregulated refrigerants. Non-compliance may result in Service termination.
11. General
11.1 These Terms are governed by Queensland law. Any disputes are subject to the jurisdiction of Queensland courts.
11.2 We may update these Terms periodically. The latest version applies to new bookings and is available on mobileautoairtech.com.
11.3 If any clause is unenforceable, it will be severed, and the remaining Terms remain valid.
11.4 Force majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, supply chain issues).
Acceptance
By booking our Services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
